1. Ownership Retention
You, the artist or rights holder, retain 100% ownership of all intellectual property rights in your musical content at all times. FFP Radio Distribution does not acquire ownership of your music, lyrics, artwork, or any associated materials.
Key Point: We are a service provider, not a rights owner. We facilitate distribution on your behalf under the limited licence you grant us.
2. Types of Rights
Composition Rights
The musical composition, including melody, lyrics, and harmony. Typically owned by songwriters and publishers.
Sound Recording Rights
The master recording of a performance. Typically owned by the artist or record label who funded the recording.
Artwork Rights
Cover art, promotional images, and visual materials associated with your releases.
Personality Rights
Your name, image, likeness, and biographical information used for promotional purposes.
3. Licence Grant to FFP Radio
By submitting content to the Platform, you grant FFP Radio Distribution a limited, non-exclusive, revocable licence to:
- Reproduce, encode, and format your content for distribution to DSPs.
- Transmit and deliver your content to digital streaming platforms worldwide.
- Collect and process royalties and payments on your behalf.
- Use your artist name, images, and biographical information for promotional and administrative purposes.
- Defend against claims of infringement related to our authorised distribution activities.
This licence is strictly limited to the purposes of digital music distribution and does not grant us any ownership or broader usage rights.
4. Right to Withdraw
You retain the right to:
- Request removal of your content from specific DSPs or all platforms.
- Terminate your distribution agreement with FFP Radio Distribution.
- Enter into separate agreements with other distributors or publishers.
- License your content directly to third parties, provided it does not conflict with existing exclusive agreements.
Withdrawal requests are processed within 30 days, subject to DSP-specific removal timelines.
5. Royalty Rights
You are entitled to:
- Receive all royalties earned from the exploitation of your content, minus our agreed commission.
- Access detailed royalty reports and analytics through your dashboard.
- Request payment once the minimum payout threshold (R500) is reached.
- Audit our royalty calculations upon reasonable notice.
Royalties are calculated based on reports received from DSPs and are subject to their reporting schedules and adjustment policies.
6. Collaborator Rights
If your content involves collaborators, co-writers, or featured artists:
- You warrant that you have obtained all necessary permissions and licences from all rights holders.
- You are responsible for ensuring revenue splits and credits are accurately reflected.
- You indemnify FFP Radio against claims arising from disputes between collaborators.
7. Moral Rights
In accordance with South African copyright law, you retain moral rights including:
- The right to be identified as the author of your work (right of paternity).
- The right to object to derogatory treatment of your work (right of integrity).
- The right not to have work falsely attributed to you.
We will not modify your content in a way that prejudices your honour or reputation without your consent.
8. Enforcement of Rights
If you believe your rights have been infringed:
- Notify us immediately at support@ffpradio.co.za.
- Provide evidence of ownership and details of the alleged infringement.
- We will investigate and take appropriate action, including takedown requests where warranted.
We cooperate fully with rights holders and legal authorities in enforcing intellectual property rights.
